Anti-Spam Policy

Utobo is committed to maintaining a trustworthy and respectful communication environment for all users. This Anti-Spam Policy outlines our strict stance against unsolicited and unwanted electronic communications sent through or in connection with the Utobo platform. All users of the Platform must comply with this Policy, which is incorporated into and forms part of the Utobo Terms and Conditions.

Definition

Spam refers to unsolicited, unwanted electronic messages sent in bulk or individually without the recipient's prior consent. This includes, but is not limited to:

UCE (Unsolicited Commercial Email): Any commercial email message sent to a recipient who has not explicitly opted in or given prior consent to receive such communications from the sender. This includes promotional emails, advertising, and marketing messages sent without permission.

UBE (Unsolicited Bulk Email): Any email message sent to a large number of recipients who have not requested or consented to receive such communications, regardless of whether the content is commercial in nature. This includes mass mailings, chain letters, and any bulk communication sent without prior consent.

Policies

Strict Prohibition of Spam

Utobo strictly prohibits the use of its Platform to send, facilitate, or support spam in any form. Users must not use Utobo's email tools, messaging features, or any other communication services to send unsolicited messages. This prohibition applies to all forms of electronic communication, including email, text messages, push notifications, and social media messages sent through or in connection with the Platform.

Consent Required

All electronic communications sent through the Platform must be directed only to recipients who have provided their explicit, informed, and freely given consent to receive such communications. Consent must be obtained through a clear opt-in mechanism where the recipient affirmatively agrees to receive communications. Pre-checked boxes, implied consent, or consent bundled with other terms do not constitute valid consent. Users must maintain records of consent for all recipients and make such records available to Utobo upon request.

Information Requirements

All commercial messages sent through the Platform must include:

  • Accurate sender identification, including the sender's name and contact information
  • A valid physical mailing address of the sender
  • A clear and conspicuous identification that the message is a commercial communication or advertisement
  • An honest and non-deceptive subject line that accurately reflects the content of the message
  • A clear and easy-to-use unsubscribe mechanism
  • Information about how the recipient's email address was obtained, if requested

Unsubscribe Mechanism

Every commercial message sent through the Platform must include a clear, conspicuous, and functional mechanism for recipients to unsubscribe from future communications. The unsubscribe process must be simple and must not require the recipient to log in, provide additional information beyond their email address, or take more than a single step to complete. The unsubscribe mechanism must remain functional for at least 30 days after the message is sent.

Respect of Unsubscribe Requests

Users must honor all unsubscribe requests within 10 business days of receipt. Once a recipient has unsubscribed, no further commercial communications may be sent to that recipient unless they subsequently opt in again. Users must not charge a fee, require the recipient to provide additional personal information, or make the recipient take any step other than sending a reply email or visiting a single web page to unsubscribe. Unsubscribed email addresses must not be sold, transferred, or shared with any third party.

Legal Compliance

Users must comply with all applicable anti-spam laws and regulations, including but not limited to the CAN-SPAM Act (United States), CASL (Canada), GDPR (European Union), the Spam Act 2003 (Australia), and any other applicable local, state, national, or international anti-spam legislation. Users are responsible for understanding and complying with the anti-spam laws of all jurisdictions from which they send messages and in which their recipients are located.

Violations

Violations of this Anti-Spam Policy may result in immediate action by Utobo, including but not limited to: suspension or termination of the user's account, removal of the user's content, temporary or permanent blocking of email-sending capabilities, reporting the violation to relevant authorities, and pursuit of legal remedies. Utobo reserves the right to determine, in its sole discretion, whether a user has violated this Policy. Repeat violators will have their accounts permanently terminated.

Updates to this Policy

Utobo reserves the right to update or modify this Anti-Spam Policy at any time. Changes will be effective upon posting of the updated Policy on the Platform. We will update the "Last updated" date at the top of this document when changes are made. Your continued use of the Platform after any changes to this Policy constitutes your acceptance of the revised Policy. We encourage you to review this Policy periodically to stay informed about our anti-spam practices.
